Abstract
Background. In recent years, due to the upsurge in international tensions and the presence of military conflicts against the background of the third wave of globalization, state sovereignty tends to strengthen. In this regard, the article, which aims at studying the impact of globalization on the genesis and public legal concept of state sovereignty, seems very relevant. Materials and methods. The materials for this article are scientific works of Russian and foreign authors on the topic under study, legislative acts of various countries, international treaties and agreements. In the process of study the author combines the dialectical, systemic, historical analysis with subsequent synthesis, as well as historical and legal analysis. Results. In the process of globalization there are three waves: 1) 1870–1914; 2) 1950–1980; 3) began after the end of the bipolar world (1991) and lasts to the present day. The first wave of globalization virtually did not affect state sovereignty. The second wave initiated its transformation, and the third one led to the dilution of the concept of state sovereignty up to the conclusion of international agreements authorizing “humanitarian intervention”. Nowadays, due to the increasing international tensions and military conflicts, despite the ongoing globalization, there is a tendency to strengthening state sovereignty and returning its public legal concept to the classical canons. Conclusions. At present, against the backdrop of the upsurge in international tensions and military conflicts, the most economically developed countries in the world are striving to reinforce their state sovereignty. A new and extremely important aspect of state sovereignty in the context of confrontation has emerged, namely digital sovereignty. The trend towards returning the public-law concept of state sovereignty to classical canons is detected.
